This week we look at: Merchandising
The key terms of our Individual Performance Agreement state that performers can choose to be paid for any Merchandising involving their voice and/or likeness. So please ensure that your agent ticks “yes” to being paid for merchandising. The details of any merchandising agreement are “to be agreed in good faith between the parties”. This means there is no standard Merchandising agreement for screen productions. Each agreement will negotiated on a case by case basis per production. If a producer agrees to pay you for Merchandising, then the details of this must be finalised before principal photography starts. If you begin filming with only an in-principle agreement from the producer to pay, you could end up with nothing.
